General Terms & Conditions

1. Scope of Application

These General Terms and Conditions (“GTC”) govern the contractual relationship between EVYTRADINGGROUP LLC (“the Company”) and its clients (“the Client”). They apply to all services and products offered, including but not limited to the Mentoring Program, Portfolio Management Services, and Online Educational Programs.

By entering into a contract or using any service, the Client acknowledges and agrees to be legally bound by these GTC.

2. Conclusion of Contract

A legally binding contract is established upon:

• selection and acceptance of a service via the Company’s website or during consultation
• explicit acceptance of these GTC during checkout or in writing
• receipt of payment confirmation or a signed contract

3. Description of Services

EvyCapitalManagement (ECM) – professional asset & portfolio management within EvyCapitalFund (ECF) and EvySavingsBank (ESB) portfolios.

EvySavingsBank (ESB) – long-term investment portfolios, target yield ~10 % p.a. (subject to market conditions). Management fee: €29.99/month.

EvyTradingSchool (ETS) – educational services in financial trading & risk management. Mentoring Program: €5,000 one-time or via installment plans.

4. Payment & Fulfillment

Accepted methods: PayPal, crypto-transfer, bank-transfer. A fixed processing fee of €50 applies per deposit into any portfolio.

Installment options (Mentoring Program) range from 24 to 100 months with interest rates between 5.0 % and 13.5 % p.a.

5. Right of Withdrawal

Clients may withdraw within 14 days of signing. Services already rendered must be paid pro-rata. Installment obligations remain even after withdrawal if services have commenced.

6. Liability & Indemnification

The Company is not liable for financial losses due to market fluctuations, economic downturns, or client decisions. Liability is limited to the fees paid for the respective service.

7. Confidentiality & IP

All educational materials, tools, and data remain the intellectual property of the Company. Copying, distributing, or commercial use without written consent is prohibited.

8. Data Protection

Personal data is collected and processed solely for service delivery and is protected through industry-standard security measures.

9. Dispute Resolution

Disputes shall first be resolved amicably. unresolved matters will be referred to arbitration under German law.

10. Final Provisions

These GTC constitute the entire agreement. Should any provision be invalid, the remainder shall remain effective. Failure to enforce any right does not constitute a waiver.
